Terms of Service

1. Agreement

These terms govern your use of this website and the free statement-analysis service provided by HighPoint Solutions. By using the site or submitting a statement, you accept them. Payment-processing services themselves are governed by the separate agreements you sign if you choose to proceed.

2. The free analysis

The statement analysis is free and carries no obligation. It is prepared from the documents and information you provide, using stated assumptions. Results are estimates for information purposes: actual savings depend on your future card mix, volume and program terms. Where we are confident, we say so; where a figure depends on assumptions, we say that too. The analysis is not legal, tax, accounting or investment advice.

3. No guarantee of savings or approval

We do not guarantee that savings are available for every business, that any particular pricing will be offered, or that a processor will approve any application. If our analysis finds no meaningful saving, we will tell you exactly that.

4. Your content

You confirm that documents you upload relate to your own business (or one you are authorized to act for) and grant us permission to store and analyze them to provide the service. Do not upload card numbers, PINs, passwords or banking credentials. Handling of your documents is described in our Privacy Policy.

5. Acceptable use

You agree not to misuse the site: no unlawful content, no attempts to breach security or access other users’ data, no scraping or automated abuse, and no uploading of malicious files.

6. Intellectual property

The site, its content and the analysis format are owned by HighPoint Solutions or its licensors. Your analysis report is provided for your business’s use; please do not republish it commercially without permission.

7. Third-party services

Links to or integrations with third-party services (for example scheduling, e-signature or card networks) are governed by those parties’ own terms. We are not responsible for third-party services.

8. Disclaimers

The site and the free analysis are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement, and do not warrant that the site will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, HighPoint Solutions will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenues, arising from your use of the site or the free analysis. Our total liability for claims relating to the free analysis is limited to one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnity

You will indemnify us against claims arising from your breach of these terms or your unlawful use of the site.

11. Governing law

These terms are governed by the laws of the state in which HighPoint Solutions is organized, without regard to conflict-of-law rules, and disputes will be brought in the courts of that state.

12. Changes

We may update these terms; the current version is always posted here with its date. Continued use after changes means acceptance.
